Photo Contest - Terms and Conditions

By participating, the participant accepts the terms and conditions stated herein.

2. The opportunity to participate begins on September 17, 2023 and ends on September 23, 2023 at 11:59 PM. Participation is open to anyone who fulfills the respective tasks and conditions of participation.
3. Only one entry per person is possible.
4. Eligible to participate are persons residing in Germany, Austria & Switzerland who have reached the age of 18.
5. The prize includes 1 scratchFEST corner scratching board.
6. The participant in the photo contest is the person who provides a photo for the contest themselves or through an authorized representative via email or via Instagram private message and agrees to conduct a photo shoot with the scratching board in the second phase - after receiving the scratching board - and to provide the organizer with at least 3 product photos of the scratching board for the online shop and marketing purposes.
7. Image rights - By submitting the application photos and the photos from the photo shoot in Phase 2, each participant declares that they hold all rights to the photos submitted by them and agrees to the publication of the photos and their personal data (see sections 11 and 12). In addition, katzenart receives the rights to edit (especially electronic image processing in online presences), reproduce, display by image carriers, and the right to transfer these rights to third parties. The aforementioned transfer of rights of use is free of charge.
   Each participant assures that the publication of their photos does not infringe any third-party rights. This includes, in particular, third-party copyrights or personal rights of photographed persons. The participant indemnifies katzenart from third-party claims arising from the infringement of such rights and the costs of legal prosecution. There is
   no right to participate in the contest and publish submitted photos. By participating, the participant agrees to the rules of the photo contest.
8. Participation is not limited to customers of the organizer and is not dependent on the purchase of goods or services.
9. Among all participants who fulfill all conditions, the winner will be determined on Sunday, September 24, 2023, and informed via Instagram private message or email.
10. The winner must accept the prize within 7 days of notification via email or Instagram private message and provide the address for shipping the prize. The prize will be sent to the address provided. The participant is responsible for the accuracy of the data provided. If the winner does not respond within the specified period, the claim to the prize will be forfeited and the prize will be re-awarded.
11. The participant expressly agrees that the personal data provided by the participant in connection with this competition will be collected, processed, and used by Mirko Haban & Kathrin Scheuerlein GbR - katzenart for the purpose of conducting the competition and any prize processing, in compliance with data protection regulations.
12. In addition, we refer to our data protection regulations.
13. The participant is free at any time to revoke the aforementioned consent to storage by written revocation to Mirko Haban & Kathrin Scheuerlein GbR - katzenart.
14. The prize is not transferable and cannot be exchanged or paid out in cash.
15. Legal recourse is excluded.
16. Mirko Haban & Kathrin Scheuerlein GbR - katzenart reserves the right to exclude participants from the competition without stating reasons if manipulation is suspected.
17. Should individual clauses be or become ineffective, the validity of the remaining clauses shall remain unaffected. German law applies.
18. Mirko Haban & Kathrin Scheuerlein GbR - katzenart reserves the right to terminate the competition at any time, in whole or in part, even without prior notice. This applies in particular if proper execution is not guaranteed for technical reasons (e.g. manipulation) or legal reasons (e.g. prohibition by Instagram).
19. The competition is not affiliated with Instagram and is in no way sponsored, supported, or organized by Instagram. The recipient of the information you provide is not Facebook, but the person responsible for this page. The information you provide will only be used for this competition.
